1. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract to use Aria. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
2. Subscriptions and billing
Paid plans are billed in advance on a monthly or annual basis and renew automatically until cancelled. Fees are non-refundable except where required by law or expressly stated. You may cancel at any time from your account settings, and cancellation takes effect at the end of the current billing period.
3. Your content
You retain ownership of content you upload, post, or otherwise make available through the Services ("Your Content"). You grant Aria a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display Your Content solely for the purpose of providing and improving the Services.
4. Acceptable use
You agree not to misuse the Services, including by violating laws, infringing third-party rights, distributing malware, engaging in fraud or spam, or attempting to disrupt or gain unauthorized access to the Services or other users' accounts. See our Acceptable Use Policy for more detail.
5. Third-party services
The Services may integrate with third-party products (for example, Stripe, Google, Meta). Your use of those products is governed by their own terms and privacy policies, and Aria is not responsible for them.
6. Intellectual property
The Services, including all software, designs, trademarks, and content provided by Aria, are owned by Aria or its licensors and protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, or create derivative works from the Services.
7. Termination
We may suspend or terminate your access to the Services at any time if you violate these Terms or if we reasonably believe your use poses a risk to Aria or other users. You may stop using the Services at any time by cancelling your subscription and closing your account.
8. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Aria does not warrant that the Services will be uninterrupted, error-free, or secure.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARIA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF YOUR USE OF THE SERVICES. Aria's aggregate liability shall not exceed the greater of USD $100 or the amount you paid Aria in the twelve months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless Aria and its affiliates from any claims arising out of Your Content, your violation of these Terms, or your misuse of the Services.
11. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Delaware, and you consent to their jurisdiction.
12. Changes
We may update these Terms from time to time. Material changes will be communicated to you, and continued use of the Services after changes take effect constitutes acceptance.
